  Congress has the power to enact this legislation pursuant to Article I, Section 8, Clause 1 of the Constitution (the Spending Clause), which authorizes Congress to provide for the common defense and general welfare of the United States, together with Article I, Section 8, Clause 18 (the Necessary and Proper Clause), which authorizes Congress to make all laws necessary and proper for carrying into execution the powers vested in the Government of the United States.
