- Constitutional authority statementThe sponsor’s statement of where the Constitution gives Congress the power to pass this bill. Statement by Mr. WALDEN, as printed in the Congressional Record (Page H6296):Consistent with the original understanding of the commerce clause, the authority to enact this legislation is found in Article 1, Section 8 of the U.S. Constitution. The SAVE Medicare Home Health Act repeals the rebasing cuts to home health services contained in the Patient Protection and Affordable Care Act. These cuts restrict patient access to home health services and reduce patient-centered control of health care decisions. By removing these cuts, the bill removes government intrusion into the doctor-patient relationship, which is protected by the 9th and 10th Amendments to the Constitution.Source: Congress.gov, record updated August 12, 2025 ↗
